1. Company Information

These Terms and Conditions (“Terms”) govern all business relationships between:

represented by its Managing Director, Michael Gerling
(hereinafter referred to as the “Seller”)

and its clients (“Customer”).

2. Scope of Application

These Terms apply to all contracts, orders, and services provided by the Seller, including the sale of pre-owned watches, custom-made jewelry, and watch sourcing services.

3. Pre-Owned Watches

All pre-owned watches are carefully inspected to the best of our knowledge and experience. Due to their pre-owned nature, signs of wear may be present.

Unless explicitly stated otherwise in writing, pre-owned watches are sold without manufacturer warranty.

4. Custom Jewelry Orders

Custom-made jewelry is produced according to the Customer’s individual specifications.

The Customer acknowledges that:

• Custom-made jewelry is personalized and non-standard

• Minor variations in weight, color, stones, or design may occur due to craftsmanship and material properties

5. Watch Sourcing Services

Upon the Customer’s request, the Seller may source a specific watch based on the criteria provided by the Customer (“Watch Sourcing Order”).

6. Deposits – Binding Order / No Right of Withdrawal

Any deposit (down payment) paid by the Customer for:

• a custom jewelry order, or

• a watch sourcing order

constitutes a binding and final order.

Deposits:

• confirm the Customer’s firm commitment

• are non-refundable

• are excluded from cancellation, withdrawal, or refund, regardless of reason

This applies in particular once production, sourcing activities, or third-party commitments have commenced.

7. Prices and Payment

All prices are stated in EUR, unless otherwise specified.

The Seller reserves the right to request full payment prior to delivery or handover.
Ownership of goods remains with the Seller until full payment has been received in full.

8. Delivery and Collection

Delivery dates are indicative only and non-binding.

Delays caused by suppliers, manufacturers, logistics partners, or force majeure do not entitle the Customer to cancel the order or claim damages.

Risk passes to the Customer upon handover or shipment.

9. Liability

The Seller’s liability is limited to cases of gross negligence or willful misconduct, to the extent permitted by law.

The Seller shall not be liable for indirect or consequential damages.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Principality of Monaco.

Exclusive jurisdiction for all disputes arising out of or in connection with these Terms shall be Monaco.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain fully effective.

12. Amendments

THEWATCHPROJECT Sàrl reserves the right to amend these Terms at any time.
The version in force at the time of the Customer’s order shall apply.
